01Agreement to these terms
These terms apply to your use of fishersearchgroup.us and the forms, content and communications offered through it (the “site”), operated by Brett Fisher Group, doing business as Fisher Search Group (“FSG,” “we,” “us”). SummitYourCareer.com and TheDecisionRooms.com are affiliated sites of Brett Fisher Group, and these terms also apply to them unless a site posts its own terms. By using the site or submitting information through it, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
02Our services
FSG is a talent search firm. We introduce medical device and MedTech professionals to companies that are hiring, and we provide search and advisory services to those companies.
- No guarantee of a response or placement. We review every submission, but we can't respond to all of them. If your background is a potential fit for what we're looking for, we may reach out to schedule a conversation or email you some qualifying questions. Submitting your information doesn't guarantee a response, an interview, an introduction, an offer or employment. Hiring decisions are made by the hiring companies, not FSG.
- We are not the employer. Unless we say otherwise in writing, any role we discuss with you is with one of our clients, and the terms of that job are between you and the employer.
- No fees for candidates. We don't charge candidates for introductions to our clients. Our search fees are paid by the companies we work with. Separate programs offered with partners, such as the Launch program powered by Evolve Your Success, are governed by their own terms and pricing.
- Client engagements. Search engagements with hiring companies are governed by separate written agreements, which take precedence over these terms where they differ.
03Information you submit
When you submit a résumé, LinkedIn profile or other information, you confirm that it's accurate, that it's yours to share, and that it doesn't include confidential information belonging to a current or former employer. You allow us to store, review and use it to provide our services, as described in our Privacy Policy. We share your résumé with a hiring company only with your permission.
04Text message program
If you opt in to text messages, you may receive informational messages about current and future opportunities in medical device and MedTech sales, marketing and clinical roles, and about your applications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, or HELP for help, or call 310-571-8117. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or SMS opt-in with third parties or affiliates for marketing purposes.
05Our content and trademarks
The site and its content, including text, design, graphics, videos, podcast material, and our frameworks and tools such as the FSG 12-Point Candidate Scorecard, the FSG 5-Star Interview Framework, the Talent Intelligence Evaluation and Value Discovery, belong to Brett Fisher Group or its licensors. Fisher Search Group, the FSG mountain mark, The Decision Rooms and SummitYourCareer are trademarks of Brett Fisher Group. You may view and share our content for personal, non-commercial use with attribution. You may not copy, adapt or commercially use it without our written permission.
06Acceptable use
Please don't misuse the site. That includes submitting false or misleading information, impersonating someone else, uploading malicious files, scraping or harvesting data, trying to interfere with the site's security or operation, or using the site for anything unlawful.
07Information only, not professional advice
Our articles, videos, podcast episodes and other content share our perspective on careers and hiring. They are general information, not legal, financial, tax or employment advice. Statistics on the site describe our past results and don't guarantee future outcomes.
08Third-party sites
The site links to services we don't control, such as Calendly, YouTube, LinkedIn and Evolve Your Success. Their terms and privacy policies apply when you use them, and we aren't responsible for their content or practices.
09Equal opportunity
We consider candidates without regard to race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, veteran status or any other characteristic protected by law, and we expect the companies we work with to do the same.
10Disclaimers
The site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available or error-free.
11Limitation of liability
To the fullest extent the law allows, FSG and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, opportunities or data, arising from your use of the site or its content. Our total liability for any claim related to the site will not exceed one hundred U.S. dollars (US$100). Some places don't allow these limits, so they may not all apply to you.
12Indemnity
If you misuse the site or break these terms, you agree to cover reasonable losses and costs, including legal fees, that FSG incurs as a result.
13Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute related to the site will be handled in the state or federal courts located in Ventura County, California, unless the law where you live requires otherwise.
14Changes to these terms
We may update these terms from time to time. We'll post the new version here and update the effective date above. Continuing to use the site after a change means you accept the updated terms.
